Staff Present:  Hillary Greenberg, Conservation Agent, David Flaherty, Assistant Conservation Agent, and Christine Bates, Committee Secretary

Meeting called to order at 4:00  P.M. by Co-Chair John DiBlasio  

Business Meeting:

Agent Greenberg reported property owners with revetments would be receiving one of three different letters regarding renourishment of revetments.   Information has been compiled on an excel file.

The Herring River technical committee and stakeholders committee will be having a joint meeting on Monday, December 12 at 10:00 in the Library.

Dottie Dolan reported the Community Preservation Committee was requesting other Boards to identify town needs.  The Historical Commission listed funds for Uncle Tim’s Bridge and Cannon Hill.  Agent Greenberg will get back with Dottie.  Discussion took place regarding who and how will the town owned lands be managed.  Research had previously been done and placed in colored folders which need to be located.

Alfred Pickard and Mr. Pilcher requested advice regarding the renourishment of a seawall and moving a creek bed.   Pickard stated the creek is migrating against the seawalls and he would like to move it back to its original location by excavating.  The creek has moved 3 to 4 properties away from the original location.  If the creek fills in, it would become a swamp.  In order to renourish the sea wall, he would need to fill in creek and move the water flow.  He would like to keep the creek open to preserve the salt marsh.  The Commission recommended Pickard prepare an NOI.  

Charles Amsler approached the Commission regarding a community farming project.  Ginie Page recused herself because she is involved with the Conservation Trust.  Amsler showed a site plan of the Old Taylor Farm.  He explained he is trying to obtain a lease from the Conservation Trust as an agricultural community farm and garden.  He explained it would restore the area, there would be no clear cutting, and the mosquito channel would be removed and berry bushes would be planted in the area.  He stated he is checking to see if there is a burial ground on the property.  He explained there would be a small number of live stock in order to have an organic farm.  Amsler had invited agents from the Barnstable County agricultural area.  Agent Greenberg stated she thought this was an opportunity with benefits for the town.  She discussed the project with Jim Mahala of DEP and he was going to further investigate the wetland issues of the property.  Discussion took place regarding the commission’s concern regarding nitrogen, the Trust’s desire to keep the land in a natural state.  Amsler stated he made a presentation to the Conservation Trust and they recommended he come to the Conservation Commission.  Denny O’Connell from the Trust stated they do not feel there is enough land for a farm, there are concerns regarding liabilities, insurance, and the Trust required further information.  Abutter Rego questioned where the access to the property would be, of which Amsler responded it would be Wellfleet Street.  The Commission stated they would need to know the details of the wetland issues before any action could take place, and Amsler would have to possess a lease from the Conservation Trust.   

Public Hearings:

Alfred Pickard for David & Aida Donald, 140 Old Briar Cliff Road, Map 35, Parcels 38 and 39:  NOI:  Replace existing concrete retaining wall with timber retaining wall using same footprint.  Pickard stated a wood wall would be placed against the rocks.  Materials will be taken away from the access point at the public landing.  Natural Heritage and DEP had not responded with their comments/ number assignment.  The wall will be placed to the original location.  Markers will be placed for beach elevations. Cyndi Moe moved to continue to January 4, 2006; seconded by Paul Banner; passed 7-0.  

Douglas and Judith Sparrow, 10 Pond Avenue, Map 29, Parcel 385:  Certificate of Compliance. Ginie Page made a site visit and stated the work was complete.  Paul Banner moved to approve a Certificate of Compliance; seconded by Dottie Dolan; passed 7-0.

Thomas and Patricia Steiner, 1 Indian Neck Road, Map 28, Parcel 231:  Certificate of Compliance.  Agent Greenberg inspected the upgraded septic system and stated everything was in order.  Gordon Peabody represented the applicant.  Cindy Moe moved to approve the Certificate of Compliance; seconded by Abby Franklin; passed 7-0.

MA Audubon Society, 291 State Highway, Map 46, Parcel 16:  NOI:  Modify portion of sanctuary trail system (Cont’d from 11/16/05).  Abby Frankllin recused herself.  DEP assigned number 77-1086 and Natural Heritage stated there would be no adverse impact.  Ginie Page moved to approve the NOI; seconded by Dottie Dolan; passed 6-0 with conditions.  Supervisors are Dottie Dolan and Ginie Page.

Abby Franklin reviewed the correspondence file which included newsletters, etc.  

Ginie Page and John DiBlasio will complete the necessary information for the Annual Town Report to be submitted by December 15, 2005.

A discussion took place regarding Wesley Swamp and the proposed Cape Cod Five Cents Savings Bank drive thru teller window.  The area may have spade foot toads.  Hillary Greenberg is attending the upcoming ZBA meeting and will report back to the Commission on the outcome of the meeting.  If the project should come before the Commission, it was felt a consultant should be hired to provide a habitat map.  

Abby Franklin reported she is resigning from the Commission to go to graduate school.  

Cyndi Moe moved to approve meeting minutes of November 16, 2005 with corrections; seconded by
Ginie Page; passed 7-0.

Cyndi Moe moved to adjourn the meeting at 5:57 pm; seconded by Ed Reynolds; assed 7-0.
